1. Introduction

Mawhub Platform was designed specially and specifically for individuals seeking for employment or services\information related to their personal employment or Job Search by individuals and\or entities searching for information related to hiring employees in the same field and to fill the vacant positions.

However, it is worth noting that Mawhub is not in any way whatsoever an employment agency or any other type of Agent, rather an independent contractor without any authority or delegation to take decisions related to hiring i.e. nothing in this Agreement or on the Platform should be construed as creating an agency relationship between us and Employers.

Mawhub is also designed to streamline Employer hiring and employment decision-making processes by allowing user access to various products such as Mawhub Interview and related Services.

Employers understand and agree that they are solely responsible for complying with applicable law regarding its employment and hiring practices. And that employer indemnifies Mawhub against any and all claims which arises or emanates out of Employer’s use of Mawhub Hiring Platform or similar products. Especially that Mawhub is not engaged in the hiring process or the decision making of employment. And Mawhub is neither procuring employees for Employer or opportunities for Job Seekers. Mawhub Serves as a tool that enables Employers and Job Seekers to exchange information as they determine.

Mawhub enjoys a discretionary power which is absolute to reject, remove, or limit visibility to any User Content, and may suspend or deactivate any account or restrict your ability to use all or parts of the Platform, at its sole discretion and without any prior notice.

Mawhub shall in all means combat any modern slavery or human trafficking in our supply chains or in any part of our business and report to the competent authority when suspecting such cases.

2. Terms of Service:

The users of The Platform, whether as Job Seekers and\or Employers and\or publisher agree that the current valid Terms of Service for All users are applicable to all.

A Job Seeker is granted the authorization to use Mawhub’s Platform and its content only for non – commercial purposes.

As an Employer, your account is for business use and not for personal use. Mawhub is not responsible for and disclaims all liability if your email is used improperly or falsely by a third party

3. Job ads or Job Listings

The objective and goals of Mawhub from creating this Platform is to reveal Job and employment opportunities, the matter which includes links to third-party platforms through Mawhub’s Panels.

The Search engines through Mawhub which might lead to third parties’ platforms is free to use. And by signing this contract, you acknowledge that you are aware of the fact that Mawhub may get compensated from sharing and spreading these Ads.

Even though Mawhub might get compensated from sharing the Ads, you acknowledge that the shared Job-Ads which reaches through Third Parties are independent from Mawhub and the latter lacks any control over, nor on the Content.

You are also aware that entering the platform of the Third Party and signing their terms and conditions legally means that you are bound to a separate agreement and your legal relation becomes with a third party without any liability of any kind whatsoever against Mawhub resulting from this relationship with the Third Party.

Mawhub may provide independent functionality to make it easier for the Job Seekers in specifying the job search, meaning that to choose between full or part time job or other features etc. Such choices are created by Mawhub, and may not be directly or accurately addressed by the intention of the Employers.

Mawhub does not guarantee that applying to jobs through a dedicated page or platform will lead to a specific desirable end-result, and even if the platform offers a phone number to contact the employer, Mawhub shall not be responsible in anyway whatsoever whether the number is correct or wrong.

4. Accounts and membership

The Platform is accessible to everyone whether visitors or registered members. However, visitors have limited access to the platform.

Therefore, creating an account with a username and password would grant you more access and additional features which are limited for visitors.

Creating an account shall be considered as a delegation to Mawhub to publish or make accessible the profile anyone accessing the platform, and you shall have the right to choose between to create your account or profile as Searchable or non- searchable. Noting that in the event you choose to put your profile to non-searchable, this will not affect in anyway whatsoever any previous applications submitted and will not prevent employers you responded to from contacting you. Therefore, you are kindly requested to update your profile and personal and contact information in a periodic and constant manner, or whenever a need to update occurs.

Anyway, Mawhub reserves its right to set any profile to non-searchable , or to limit your ability to set your profile to searchable, at any time and with full and absolute power based on its discretionary power or to suspend the account and\or turn it offline if the said account contained prohibited content , or in order to prevent illegal conduct, for fraud mitigation, as set out in the current terms and conditions or according to the valid law or for any valid reason as considered by Mawhub.

The terms associated with any Mawhub service you are using, and all of Mawhub’s policies, including the Mawhub Privacy Policy and Cookie Policy, apply to you.

Mawhub uses cookies and similar tracking technologies to enhance user experience, analyze platform traffic, and deliver personalized content. A detailed Cookie Policy is available https://hrtechprivacy.com/brands/indeed#cookie-policy.

When you create a Mawhub account, Mawhub may require that you verify your identity, and you may choose to verify your identity of one of different options and selections, and you will be subject to the special rules and regulations related to the said choice, without any liability of any kind and in anyway whatsoever on Mawhub.

5. Applying to Jobs Through the Platform

Using this Platform is subject to this agreement which shall be construed as a binding agreement. And which is subject to the terms and conditions mentioned herein and the privacy policy adopted by Mawhub. And Mawhub at its sole discretion may impose limits on your ability to apply to Job Listings or to other services.

You are requested to double check your personal information before submitting them and make sure that they correct, accurate and up to date. Given that all information and documents submitted by you are on your full and complete liability.

Noting that after the application is submitted, Mawhub does not have control over the Employer’s use or disclosure of that information. And any request in this sense shall be submitted to the Employer directly, in written or through email.

Job Ads may expire or otherwise be removed between the time you submit your application and the time it is received, in such cases your application will be void.

Mawhub and its third-party providers may store your application and related information regardless of whether a Job Listing has been closed or is no longer available on the Platform.

By using the Platform, you agree that Mawhub is not responsible for the content of the Employer’s job application, requirements, messages, screener questions, skills assessments or their format or method of delivery, and that Mawhub does not guarantee receipt of your application by the Employer, or your receipt of messages from the Employer. Employers are solely responsible for compliance with all applicable laws.

You acknowledge that as part of its efforts to combat fraud and spam, Mawhub may require that users verify their email address. When you apply to a job through the Platform, you agree that you may be required to verify your email address, and that failure to verify may lead to your application being rejected.

6. Virtual Communications

You acknowledge that Mawhub is not a telecommunications service provider and that it only facilitates communication with Employers through services offered by third-party providers.

Please note that because these telecommunication services rely on the functionality of third-party providers, there may be technical delays or malfunctions for which Mawhub is not responsible. Mawhub does not guarantee any aspect of the Virtual Interview Experience, including the transmission of phone or video communications, the quality of audio/visual content, data security, or data usage and restrictions. Additionally, you acknowledge that Virtual Interviews may be recorded and agree to comply with any notifications (visual, audio, or otherwise) regarding the recording.

If you do not consent to being recorded, you must either refrain from participating in the pre-recorded interview or leave the Virtual Interview immediately. By using Virtual Interviews, you agree to the recording of the session and grant Mawhub and third-party providers the right to store, access, and analyze the recording.

Furthermore, you also agree that the Employer may access, store, use, analyze, and share the recording. This activity is outside of Mawhub's control, and Mawhub shall not be liable in any way.

7. Salary and Other Information Provided by Mawhub

Mawhub may provide users with salary information and other content for informational purposes only. This includes estimated salaries for specific job listings, the number of applications for a job listing, and responses to certain screener questions related to a job listing etc.

The information provided by Mawhub is based on estimates for informational purposes only, without any warranty. It is subject to change and may vary in accuracy.

Mawhub may display publicly available information about employers on Company Pages. This information is intended for informational and promotional purposes only, is subject to change, and may be sourced from or generated by third parties.

Without any liability on Mawhub in anyway whatsoever.

9. Employer Services Including Mawhub Apply and Screener Questions:

Job seekers can express interest in job listings via Mawhub Apply, and Mawhub will send applications to the email address you provide. Additionally, you agree that Mawhub may activate a chatbot, allowing job seekers to apply for your job ad by answering questions. The responses submitted by job seekers will be presented to you as part of their job application. By using Mawhub's candidate management tools, including your Employer Dashboard and the Mawhub Apply relay function for your job listings, you acknowledge and agree that Mawhub may provide features that enable you to manage job seekers. These functions include setting up interviews, viewing resumes, and rejecting candidates.

You further agree that Mawhub is not responsible for maintaining or storing such application materials, and that you are responsible for your own compliance with any applicable record retention, reporting requirements or other applicable law.

In a Candidate Summary or other products and services on the Platform, you may encounter verifications of a job seeker’s skills, certifications, or other qualifications. However, Mawhub does not guarantee the accuracy of these verifications or information, and you are solely responsible for verifying the information presented on the Platform.

You acknowledge that you are solely responsible for ensuring compliance with all applicable laws regarding the content on the Platform, including minimum wage requirements, wage transparency laws, and any other relevant regulations.

If you include voluntary self-identification questions for job seekers with your application materials, you are solely responsible for ensuring compliance with applicable laws regarding the content and format of these questions, as well as how you use the job seekers' responses. You also bear full responsibility for adhering to all regulatory requirements related to the collection and reporting of demographic information about applicants.

If you close or change any Job Listings that you post, you agree to promptly update such Job Listings on the Platform or otherwise notify Mawhub.

You acknowledge that Mawhub has the right to reject or remove any Job Listing or any questions for Job Seekers for any or no reason

You acknowledge and agree that it is your responsibility to ensure that your Job Listing requirements and criteria are relevant to the job and comply with applicable laws.

Mawhub does not guarantee delivery, the receipt of the Job Seeker's emails or application materials, or that there will be no errors in the transmission or storage of data.

In the event a message is sent is sent to a closed account, it will not be deliverable.

Mawhub cannot verify the contact information you provide. If you submit incorrect contact details, it is your responsibility to correct them and take any necessary actions to protect the privacy of the Job Seekers. You also agree to indemnify Mawhub for any resulting damages from this situation.

You acknowledge that you are solely responsible for complying with all applicable nondiscrimination laws. Mawhub disclaims any warranty concerning the demographic composition of Job Seekers applying to any specific job.

When you use Mawhub Apply for your Job Listings, you acknowledge and agree that Mawhub may add functions into the corresponding Mawhub Apply emails. In addition, Mawhub may, on your behalf, send out reminder emails to Job Seekers you wish to interview. Mawhub may send emails to Job Seekers on your behalf to indicate that your Job Listing could be a good match for their resume. If you utilize screener questions, you may have the option to direct Mawhub to send rejection notices if the Job Seeker does not respond according to the provided online instructions. If you select this option, those candidates will receive rejection notices and will be marked as rejected in your candidate dashboard. You also acknowledge that Mawhub has no control over the sending or storage of these rejection notifications, which is purely mechanical. Additionally, transmission or storage is not guaranteed, and there is a possibility that the Job Seeker may not have answered the screener questions accurately.

You are responsible for ensuring that your selection criteria are relevant to the job. You must avoid making "disability-related inquiries" or medical inquiries that violate the law, and you should not exclude individuals with disabilities or members of any protected category as defined by law.

You also agree that Mawhub has no control over the transmission or storage of these interview invitations, which are purely mechanical. Transmission and storage are not guaranteed, and the information provided by the Job Seeker may not be accurate. Mawhub may ask Job Seekers to confirm their interest in the position before scheduling an interview. The Employer has sole discretion in deciding which Job Seekers to interview and can choose to interview any candidate at any time. By scheduling these interviews, Mawhub does not guarantee that a Job Seeker is qualified, meets the Employer's criteria, or that the information provided by the Job Seeker to Mawhub is accurate. Mawhub candidate management tools are designed to help Employers connect more efficiently with Job Seekers. However, the Employer holds full responsibility for the content of any screener questions, decisions regarding interviews or job offers, and any issues that may arise from accepting or denying employment, as well as any other concerns related to the use of these tools.

By using this and other candidate management tools, you acknowledge and agree that Mawhub is not responsible for procuring employees for Employers or job opportunities for Job Seekers. Additionally, Mawhub does not serve as your employment agency by providing these candidate management tools.

You agree to indemnify, defend, and hold harmless Mawhub, along with its agents, affiliates, and licensors, from any third-party claims or liabilities (including reasonable legal fees) that arise from any Company Page you create or claim, any Job Listing, application materials, voluntary self-identification questions, screener questions (or their answers) posted by you, or any messages sent by you. Mawhub may provide Job Ad analytics data on a Company Page or elsewhere on the Platform. Additionally, Mawhub may share analytics data related to your Employer account with anyone in your company at its discretion. To the extent permitted by law, if you have any unpaid or outstanding invoice or account balance for a Mawhub product, Mawhub reserves the right to suspend or terminate your access to that product and any other Mawhub products, as outlined in the IO for that product. This includes products for which you do not have an unpaid invoice or account balance. Mawhub may choose to impose (i) penalties for late payment, up to the maximum interest allowed by law, and (ii) any reasonable expenses and attorney fees incurred in the collection of such late payments.

Mawhub, at its sole discretion, may add labels or badges to Employer names or Job Ads, such as "Responsive Employer," "Active Employer," "Hired on Mawhub," or "Verified." Employers can also request the addition of these labels. Mawhub will determine the criteria for adding such labels or badges and which Employers qualify. The absence of a label or badge may indicate that Mawhub lacks sufficient data to determine an Employer's qualification. Mawhub does not guarantee the accuracy of any labels or badges applied to Employer names or Job Ads. Mawhub reserves the right to change or remove these labels or badge features at any time, at its sole discretion.

MAWHUB DENIES ALL LIABILITY ARISING OUT OF YOUR USE OF ANY MAWHUB API. You are responsible for regularly reviewing the Mawhub Platform for the most current information about Mawhub’s products and services. This includes, but is not limited to, explanations of how features work, disclaimers, disclosures regarding the services provided, and methods of charging.

10. Job Match:

Job matches are recommendations that may be presented to you as an Employer and to Job Seekers in various formats on the Platform. To generate these matches, Mawhub utilizes data collected from both Employers and Job Seekers, including Job Ads, resumes, application materials (such as responses to screener questions), Mawhub Assessments, and user activity on the Platform (like searches conducted and Job Ads clicked on or applied to). You agree and consent to Mawhub using this information to present potential matches to you and to Job Seekers.

11. Communication through the Platform:

All communications provided by Mawhub through the Platform—whether via the app, email, or dashboard—in response to the Employer's or Job Seeker's activity on the Platform are made purely as a courtesy. Mawhub has no obligation regarding these communications, and they should not be considered reliable or guaranteed. Mawhub disclaims all warranties related to the transmission of these courtesy communications.

Communication through Mawhub messaging and any other communication methods provided by Mawhub is limited to the purpose of hiring for job listings. Mawhub reserves the right to enable or disable Mawhub Messaging and other communication options at its discretion, without prior notice. Mawhub is not responsible for any technical delays or errors that may occur with these communication methods.

Mawhub may mask or hide contact information, such as phone numbers and email addresses, substituting them with an alias. The messaging system is not designed for sending a single message to multiple Job Seekers; therefore, you cannot use Mawhub’s Messaging services for bulk messaging unless explicitly approved by Mawhub.

You acknowledge and agree that only sponsored Job Ads may be displayed, and that using Text to Apply or Scan to Apply is a benefit associated with sponsoring those Job Ads.

13. Special Terms related to Publishers:

These special terms apply to any publisher that accesses, participates in, or uses Mawhub’s Platforms or any of its features in relation to job publishing or by indicating consent to these terms.

Mawhub has full discretion to approve or deny any publisher’s participation in any features of the Platform. Publishers are ineligible to use any feature if they do not comply with Mawhub's General and Specific terms and conditions. Participants warrant that all information provided is true, accurate, and complete.

Publishers must label each displayed Program Element with the phrase “Jobs by Mawhub.” The word “Jobs” should be hyperlinked to http://www.Mawhub.co or another Mawhub Platform as agreed upon, and the word “Mawhub” must use the Mawhub Logo Image, which should also be hyperlinked to http://www.Mawhub.co or another agreed- upon Mawhub platform. For your convenience, we provide the Mawhub Logo Image online.

The Publisher grants Mawhub permission to reference the Publisher and its platforms in Mawhub’s marketing materials, wherever these materials may appear. Participation in the features of the Mawhub Platform is free of charge, and the Publisher explicitly agrees and acknowledges that no monetary compensation, including commissions, will be provided to Mawhub for participating in or using the Mawhub Publisher Program in any way.

14. Terms of Service for All users:

The following terms and rules apply to anyone who accesses or uses any part of the Platform, in any capacity. By entering the Platform, you acknowledge and agree to the terms and conditions of this agreement, which include, but are not limited to, the prohibition against submitting or posting any commercial communications to the Platform.

By using the Platform, you acknowledge and agree that Mawhub collects, records, processes, analyzes, and stores all activities you undertake on the Platform, as well as any interactions and communications you have with others on or through the Platform.

When you use the Platform, you are requesting that Mawhub send data, text, and images that may be stored temporarily or permanently on your device. For more information on controlling tracking technology, please refer to our Policy. Additionally, you authorize Mawhub to use processes that record or decode dialing, routing, addressing, and signaling information, which you acknowledge is necessary for the operation of the Platform.

Your use of information is at your own risk. Mawhub may implement improvements or developments without prior notice or consent. These enhancements are provided as a courtesy and come without any warranty, based on information supplied by other users.

17. Accessing External Platforms:

The Platform includes links to other platforms on the internet that are owned and operated by third parties (“External Platforms”), such as Employer platforms, Applicant Tracking Systems, or promotional platforms. Links to External Platforms may appear in User Content available on the Platform (for example, Resumes or Job Ads). Mawhub is not responsible or liable for any External Platform, including its availability or content. Links to External Platforms may be removed at any time. Any concerns regarding an External Platform should be directed to the third party in charge.

Mawhub has no control over the activities on External Platforms. If you visit an External Platform and complete a transaction outside of Mawhub, you are entering into an agreement with a third party, solely at your own risk.

Mawhub may provide you with access to a link to services or products offered by a third party (“Third-Party Service”). Mawhub acts solely as a technical conduit, facilitating the transmission of background checks sent from a background check Third-Party Service to you. Please note that you acknowledge Mawhub cannot and does not assemble, access, view, analyze, manipulate, alter, evaluate, or store the background check reports provided by any background check Third-Party Service to you or any other Mawhub user.

19. Billing Policies

Invoices may be sent to you via email, unless otherwise specified by Mawhub. Mawhub reserves the right to suspend or terminate your use of that product, as well as any other Mawhub products, including those where you do not have an unpaid invoice or account balance. You waive all claims related to charges unless submitted within 120 days after the charge (this does not affect your rights to dispute charges with your credit card or bank).

20. E-Signature

The Platform may provide e-signature options powered by a third-party service provider. By using e-signatures on the Platform, you acknowledge that your e-signature is intended to authenticate the document you are signing and will carry the same legal weight as a manual signature. Your use of e-signatures is at your own risk, and it is your responsibility to ensure that your document is received and to retain your own copies.

21. Intellectual Property

Copyright for all material contained on, in, or available through the Service—including information, data, text, music, sound, photographs, graphics, video messages, the selection and arrangement of these elements, as well as all source code, software compilations, and other material (“Material”)—is owned by or licensed to or its group companies. All rights are reserved.

The trademarks, service marks, and logos (“Trade Marks”) included in the Service are owned by MAWHUB, its group companies, or third-party partners of MAWHUB. You are not permitted to use, copy, edit, modify, reproduce, publish, display, distribute, store, transmit, commercially exploit, or disseminate the Trade Marks without the prior written consent of MAWHUB, the relevant group company, or the applicable third-party partner of MAWHUB.

22. Indemnification:

You agree to indemnify, defend, and hold harmless Mawhub, its agents, affiliates, and licensors from any claims or liabilities (including reasonable legal fees) arising out of or related to: (a) your violation of any term of this Agreement; (b) your use of or access to the Platform or any Mawhub product, program, or service; (c) any loss or disclosure of information obtained from using the Platform or any Mawhub product, program, or service; (d) your violation of any applicable laws or regulations, including but not limited to the Fair Credit Reporting Act, employment, equality, discrimination laws, and data protection or privacy laws (including any claims that Mawhub, as your agent, violated such laws); (e) your violation of any third-party rights, including but not limited to copyright, property, or privacy rights; (f) any claim that your content caused harm to a third party; (g) your actions as an Employer, including screening, hiring, promoting, or demoting any employee or Job Seeker; or (h) the activities of any third-party service providers you engage to assist with your use of Mawhub products and services, such as facilitating sourcing activities or tracking job seeker conversion rates. This indemnification and defense obligation will survive the termination of this Agreement and your use of the Platform or any Mawhub product, program, or service.

23. Governing Law and Dispute Resolution

This Agreement and any dispute arising out of or in connection with this Agreement or related in any way to the Platform (“Dispute”) will be governed as to all matters, including, but not limited to the validity, construction and performance of this Agreement, by and under the laws of the United Arab Emirates.

Give that as partial consideration for your use of the Platform and the Publisher Program, you agree not to sue Mawhub as a class plaintiff or class representative, join as a class member, or participate as an adverse party in any way in a class-action lawsuit against Mawhub regarding your use of the Platform. Additionally, as a Job Seeker, you acknowledge that your use of job search, Mawhub Apply, and other free services on the Platform is not purchased. Your acceptance of this Agreement, including this Class Action Waiver, is an essential part of the bargain allowing your free use of the Platform. If you do not agree to any part of these terms, do not continue your use of the Platform. Nothing in this paragraph, however, limits your rights to bring a lawsuit as an individual plaintiff, including in small claims court.

24. Class Action Waiver

By using the Platform and in return for the services offered by Mawhub, you acknowledge that Mawhub can only offer you these services under the terms and conditions as presented herein. As partial consideration for your use of the Platform and these services, you agree not to sue Mawhub as a class plaintiff or class representative, join as a class member, or participate as an adverse party in any way in a class-action lawsuit against Mawhub regarding your use of the Platform. If you do not agree to any part of these terms, do not continue your use of the Platform. Nothing in this paragraph, however, limits your rights to bring a lawsuit as an individual plaintiff, including in small claims court, subject to Section 11 above.

27. Acceptance of Terms

By default, your access to and use of Mawhub’s platform and services signifies your agreement to these Terms of Use and the Privacy Policy.

If you do not agree to these terms, you must untick the box below. By leaving the box checked, you confirm the following:

1. You agree to the Terms of Use and Mawhub’s Privacy Policy.

2. You consent to the collection, use, and processing of your personal data as outlined in the Privacy Policy.

3. If acting on behalf of an entity, you confirm that you have the authority to bind that entity to these terms.
